Fairness Hearing Held. The parties advise the Court that there is no opposition to the jointly proposed settlement agreement and no one appeared at the hearing to oppose the settlement. The Court finds the settlement is fair, reasonable, adequate, and in the best interests of the parties, class members and the public. The settlement agreement complies with Fed.R.Civ.P. 23(e). All 5 requirements set forth in Fed.R.Civ.P. 23(e) have been met. It is therefore, Recommended that the Court approve the parties' jointly proposed settlement agreement.
